Acceptance of Terms
By accessing or using the FreshPickKat User App, you agree to these Terms and Conditions and the FreshPickKat Privacy Policy. If you do not agree, you should stop using the app.
Account Responsibilities
- You are responsible for keeping your phone, OTP, login session, and account information secure.
- You must provide accurate name, phone number, address, location, and payment information.
- You are responsible for activity from your account unless caused by FreshPickKat's proven security failure.
- You must promptly update incorrect delivery or contact details before placing an order.
User Conduct Rules
You agree not to misuse the app, place fraudulent orders, abuse offers or coupons, interfere with service operations, reverse engineer the app, attempt unauthorized access, harass delivery or support staff, or use the service for unlawful purposes.
Order Cancellation Rules
You may cancel eligible orders from the User App while the order is in an early status such as placed, pending, or confirmed. Orders may not be cancellable once they are packed, out for delivery, delivered, or otherwise processed beyond the cancellation window.
FreshPickKat may cancel an order due to product unavailability, incorrect pricing, delivery limitations, suspected misuse, payment failure, address issues, or circumstances beyond our control.
Refund Conditions
- Refunds may be issued for eligible cancelled orders, failed or duplicate payments, unavailable items, missing items, or approved service issues.
- Refund eligibility depends on order status, payment status, delivery status, product condition, and review by FreshPickKat.
- Online payment refunds are generally sent to the original payment method and may depend on Razorpay, bank, UPI, or card network timelines.
- FreshPickKat may reject refund requests involving fraud, misuse, inaccurate claims, or failure to provide required information.
Delivery Limitations
Delivery availability depends on serviceable locations, product availability, order value, weather, traffic, staffing, local restrictions, and accurate address or location information. Estimated delivery times are not guaranteed.
You must be available to receive the order at the delivery address. FreshPickKat may contact you using the phone number linked to the order.
Payment Rules
FreshPickKat supports online payments through Razorpay in INR. Payment options may include UPI and other methods made available by Razorpay or the app. Your order may be confirmed only after payment verification or valid payment selection.
Cash on Delivery may be available only when shown in checkout for eligible locations, order values, and accounts. If COD is not shown, you must use the available online payment option.
You agree not to dispute valid charges without first contacting FreshPickKat support and providing order details.
Intellectual Property
The FreshPickKat name, app design, logos, content, product presentation, software, images, graphics, and related materials are owned by FreshPickKat or its licensors. You may not copy, modify, distribute, sell, or misuse them without written permission.
Service Availability
FreshPickKat aims to keep the User App available and reliable, but service may be interrupted by maintenance, updates, network issues, third-party outages, payment gateway downtime, technical failures, or events outside our reasonable control.
Account Suspension
FreshPickKat may suspend, restrict, or terminate access to the User App if we believe there is fraud, misuse, abusive behavior, payment risk, repeated false claims, security risk, violation of these terms, or legal obligation.
Liability Limitations
To the maximum extent permitted by law, FreshPickKat is not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from use of the User App.
FreshPickKat's total liability for a specific order-related claim will not exceed the amount paid by you for that order, except where the law requires otherwise.
Changes to Terms
FreshPickKat may update these Terms and Conditions from time to time. Updated terms will be posted on this page with a new last updated date. Continued use of the User App after updates means you accept the revised terms.
Governing Laws
These Terms and Conditions are governed by the laws of India. Courts and authorities with jurisdiction under applicable Indian law will handle disputes, subject to any mandatory consumer protection rights available to you.
